Supreme Court weighs pitfalls of multipart deportation notices
On Monday, November 9, 2020, for the second time in three years, the Supreme Court considered the potential benefits and faults in requiring the government to include all required information in a single document when initiating deportation proceedings. While the government contends that requiring them to produce a court date as early as the initial deportation notice would be difficult, the attorney representing a Guatemalan citizen fighting deportation maintained that while rescheduled hearings may be a reality, it is “still very helpful to have all this information in one place.” The justices appeared swayed by the latter argument, and the Court’s decision will resolve a circuit split on this issue.
